Effective upon Payment
1. ACKNOWLEDGEMENT AND ACCEPTANCE OF TERMS
By renting equipment from Bespoke Concierge LLC (hereinafter referred to as the “Company”), the renter (“Customer”) acknowledges and agrees to the terms of this Liability Waiver and Release Agreement. The Customer understands that by completing the rental transaction, they voluntarily accept all risks associated with the use of the rented equipment and agree to release the Company from any liability.
By proceeding with payment, the Customer confirms that they have read, understood, and agreed to this Liability Waiver and Release Agreement.
2. ASSUMPTION OF RISK
The Customer acknowledges that the use of rented equipment , including but not limited to baby equipment, pet equipment, children's toys, outdoor equipment, and other rental items, carries inherent risks. These risks may include injury, illness, property damage, or other unforeseen issues. The Customer assumes full responsibility for the proper use and supervision of all rented equipment.
3. RELEASE OF LIABILITY
The Customer, on behalf of themselves, their heirs, legal representatives, and assigns, hereby releases, waives, and discharges the Company, its owners, employees, and affiliates from any and all claims, liabilities, damages, injuries, or losses, whether caused by negligence or otherwise, arising from the use of the rented equipment.

5. PROPERTY DAMAGE DISCLAIMER
Bespoke Concierge is not responsible for any damage to the property owned or rented by the Customer, including but not limited to homes, vehicles, hotel rooms, or rental properties, caused by the use or placement of rented equipment.
6. REFUND & CANCELLATION POLICY
7. DAMAGE & LOSS POLICY
If rented items are lost or damaged beyond simple repairs, the Customer will be responsible for the full replacement cost of the item, including any shipping fees associated with replacing it.
8. INDEMNIFICATION
The Customer agrees to indemnify and hold harmless Bespoke Concierge from any claims, damages, or expenses (including attorney fees) arising from their use or misuse of the rented equipment.
9. DISCLAIMER OF WARRANTIES
Bespoke Concierge provides rented equipment “as-is” and makes no warranties, express or implied, including but not limited to merchantability or fitness for a particular purpose.
10. FORCE MAJEURE
Neither the Company nor the Customer shall be liable for any failure or delay in performance under this Agreement due to the events or circumstances beyond their reasonable control, including (but not limited to) acts of God, natural disasters, pandemics, governmental actions, or other similar events.
11. LIMITATION OF WAIVER
Nothing in this agreement shall be construed to waive the Customer’s right to pursue claims for damages arising from the Company’s gross negligence, willful misconduct, or intentional acts. To the extent permitted by applicable law, the Customer agrees that the release of liability does not apply to such actions.
12. MODIFICATION
This Agreement may only be amended or modified by a written document duly signed by both the Customer and an authorized representative of the Company.
13. NOTICES
Any notices or communication required or permitted under this Agreement shall be in writing and delivered via email or certified mail to the addresses provided by the parties.
14. AGREEMENT TO TERMS
By completing this rental transaction, the Customer acknowledges they have read, understood, and agreed to the terms of this Liability Waiver and Release Agreement. Payment for the rental constitutes acceptance of this agreement.
15. ARBITRATION AND VENUE
Any disputes or legal matters arising out of or in connection with this Liability Waiver and Release Agreement shall be resolved through binding arbitration in Boone, North Carolina. The Customer agrees to submit to the jurisdiction and venue of the courts located in Boone, North Carolina for any legal matters not resolved through arbitration.
16. GOVERNING LAW
This agreement shall be governed by and interpreted in accordance with the laws of the State of North Carolina.
